Internet Archive's "controlled digital lending" system and removal of controls during the pandemic don't qualify as fair use, the Second Circuit affirmed Wednesday. Bloomberg Law: Four major book publishers again thwarted the online repository's defense that its one-to-one lending practices mirrored those of traditional libraries, this time at the US Court of Appeals for the Second Circuit. Copying books in their entirety isn't transformative, and lending them for free competes with the publishers own book and ebook offerings, the unanimous panel said. Internet Archive said in a statement: We are disappointed in today's opinion about the Internet Archive's digital lending of books that are available electronically elsewhere. The Internet Archive took a tumble overnight after "environmental factors" downed the Wayback Machine, leaving archive.org wobbling in a way that might bring a smile to the faces of certain publishers wishing for its demise. From a report: According to the organization, there was a "brief power outage in one of our datacenters," which was followed by "environmental factors," causing the service blackout. Those environmental factors are likely to be an increase in heat following a cooling outage. By this morning, The Internet Archive was reporting that things were back up and running again. However, some users (this writer included) are still experiencing the odd error or two when accessing the organization's services.

Pornhub plans to block access to its website in Indiana, Idaho, Kansas, Kentucky, and Nebraska in response to age verification laws designed to prevent children from accessing adult websites. From a report: The website has now cut off access in more than half a dozen states in protest of similar age verification laws that have quickly spread across conservative-leaning US states. Indiana, Idaho, and Kansas will lose access on June 27th, according to alerts on Pornhub's website that were seen by local news sources and Reddit users; Kentucky will lose access on July 10th, according to Kentucky Public Radio.

Japan's birth rate fell to a new low for the eighth straight year in 2023, according to Health Ministry data released on Wednesday. A government official described the situation as critical and urged authorities to do everything they can to reverse the trend. From a report: The data underscores Japan's long-standing issues of a rapidly aging and shrinking population, which has serious implications for the country's economy and national security -- especially against the backdrop of China's increasingly assertive presence in the region. According to the latest statistics, Japan's fertility rate -- the average number of babies a woman is expected to have in her lifetime -- stood at 1.2 last year. The 727,277 babies born in Japan in 2023 were down 5.6% from the previous year, the ministry said -- the lowest since Japan started compiling the statistics in 1899. Separately, the data shows that the number of marriages fell by 6% to 474,717 last year, something authorities say is a key reason for the declining birth rate. In the predominantly traditional Japanese society, out-of-wedlock births are rare as people prize family values.

Japan's Toshiba said on Thursday it will cut up to 4,000 jobs domestically as the industrial conglomerate accelerates restructuring under new ownership. From a report: Toshiba delisted in December due to a $13 billion takeover by a consortium led by private equity firm Japan Industrial Partners, capping a decade of scandal and upheaval. The consortium's efforts to engineer a turnaround at Toshiba are seen as a test for private equity in Japan, which used to be seen as "hagetaka" or vultures due to its rapacious reputation. The restructuring amounts to up to 6% of Toshiba's domestic workforce. The company also said it would relocate office functions from central Tokyo to Kawasaki, west of the capital, and target an operating profit margin of 10% in three years.

LastPass, the password manager company, has officially separated from its parent company, GoTo, following a series of high-profile hacks in recent years. The company will now operate under a shareholder holding company called LMI Parent. LastPass -- owned by private equity firms Francisco Partners and Elliott Management -- has faced criticism for its handling of the breaches, which resulted in the theft of customer data and encryption keys. The company has since enforced a 12-character minimum for master passwords to improve security.

AV1 -- a next-generation, royalty-free video codec developed by the Alliance for Open Media, a consortium including tech giants like Google, Mozilla, Cisco, Microsoft, Netflix, Amazon, Intel, and Apple -- is finally making inroads. From a report: We are finally seeing more hardware support for this codec. The new M3 chips from Apple support AV1 decode. The iPhone 15 Pro and iPhone 15 Pro Max also feature an AV1 hardware decoder. The official Android 14 Compatibility Definition makes support for AV1 mandatory. The Snapdragon 8 Gen 2 chipset, widely used by Android phones released in 2023, supports AV1. With the exception of Microsoft Edge, all browsers support AV1.

Japan's contribution to world-class research continues to decline, despite having one of the world's largest research communities, according to a report by the Japanese Ministry of Education, Culture, Sports, Science and Technology (MEXT), released in English on 25 October. From a report: Masatsura Igami, the director of the Center for S&T Foresight and Indicators at the National Institute of Science and Technology Policy (NISTEP) in Tokyo, and one of the authors of the 2023 edition of the Japanese Science and Technology Indicators report, says that the findings highlight several areas that Japan could explore to improve its global standing. "Japan's current research environment is far from ideal and is unsustainable. The research environment must shape up," he says. The report shows that Japan ranks third globally in the total number of researchers, following China and the United States. However, this workforce is not producing the same level of high-impact research as it was two decades ago. Japan's global share of research papers in the top 10% of most-cited articles has slipped from 6% to 2%, intensifying concerns in Japan about its dwindling international standing. Igami explains that the rest of the world has overtaken Japan in terms of quality research output. Some of the decline might be attributable to funding, Igami says. The 2023 report shows that research spending in the university sector has grown by roughly 80% in the United States and Germany, and 40% in France, has quadrupled in South Korea and has increased more than tenfold in China over the past two decades. By contrast, Japan's spending has increased by 10%. However, even if researchers receive more funding, producing high-impact research might still be challenging, because Japanese scientists have less time for actual research, Igami says. According to a 2020 analysis by MEXT, the proportion of time that university researchers dedicated to science decreased from 47% to 33% between 2002 and 2018. [...] The report's findings confirm those of a previous survey of early-career researchers that pointed to a lack of time for research as a notable factor in job dissatisfaction.

An anonymous reader shares a report: Paris became the first European capital to outlaw the vehicles on Friday, following a vote in April in which Parisiens overwhelmingly supported a ban, although turnout was low. Privately owned e-scooters, which the city cannot regulate, are exempt. Since their eruption onto the streets and sidewalks of cities across the world in 2019, e-scooters have posed unique regulatory problems for city officials. The vehicles often stayed in legal limbo as officials mapped out charters for e-scooter operators, capped fleets and regulated parking. Cities like San Francisco and Miami temporarily banned e-scooters before reintroducing them. Santa Monica, Calif., successfully sued an e-scooter operator over its lack of licensing. And New York delayed the vehicles' arrival, citing security concerns. But no city has been as strict as Paris, where e-scooter users are mourning a cheap and flexible way of getting around without having to ride the crammed metro or use Velib', the popular but frequently overwhelmed bike-sharing system.

The PC market is in rough waters, and it was for much of last year. Every PC maker except Apple saw year-over-year decline. Laptop sales are said to have suffered the most. From a report: This all made for a somewhat uncertain backdrop heading into CES 2023, the annual conference where tech companies show off the products they'll be releasing in 2023. Throughout the show, executives and representatives from various PC manufacturers acknowledged that the industry has a big task ahead of it this year: keep the laptop exciting. Some companies are trying to do that with goofy hardware things (such as Lenovo's dual-screen, dual-OLED, and touchpad-less Yoga Book 9i). But others are moving away from hardware -- and the raw power that hardware can provide -- and emphasizing quirkier software capabilities in this year's lineups. AMD revealed that some of its new chips will come with its first Ryzen AI engine, built on its XDNA architecture. Intel's upcoming Meteor Lake chips will also bring AI capabilities. HP announced new features for its Omen Gaming Hub, including integration with Nvidia's GeForce Now, and new remote management and insight services for IT. A consumer Windows PC, the Dragonfly Pro, was also unveiled, with its integration with HP's new "live concierge" service touted as a highlight. The report adds: And HP isn't alone in this conviction -- quite a few other manufacturers that had a big presence at CES this year emphasized showy software features that utilized camera tracking and AI, from Asus' and Acer's glasses-free 3D displays to Razer's soundbar that follows your head around to optimize your music. Even Lenovo's aforementioned dual-screen Yoga Book is a software offering in many ways; the form factor is hardly new, but the investments Lenovo has made in an impressive system of gesture control are what make it a viable product.

Japan adopted a plan on Thursday to extend the lifespan of nuclear reactors, replace the old and even build new ones, a major shift in a country scarred by the Fukushima disaster that once planned to phase out atomic power. From a report: In the face of global fuel shortages, rising prices and pressure to reduce carbon emissions, Japan's leaders have begun to turn back toward nuclear energy, but the announcement was their clearest commitment yet after keeping mum on delicate topics like the possibility of building new reactors. Under the new policy, Japan will maximize the use of existing reactors by restarting as many of them as possible and prolonging the operating life of aging ones beyond a 60-year limit. The government also pledged to develop next-generation reactors. In 2011, a powerful earthquake and the ensuing tsunami caused multiple meltdowns at the Fukushima Daiichi plant -- a disaster that supercharged anti-nuclear sentiment in Japan and at one point led the government to promise to phase out the energy by around 2030. But since then, the government has recommitted to the technology, including setting a target for nuclear to make up 20-22% of the country's energy mix by the end of the decade.

AmiMoJo writes: LastPass says unknown attackers breached its cloud storage using information stolen during a previous security incident from August 2022. The company added that, once in, the threat actors also managed to access customer data stored in the compromised storage service. "We recently detected unusual activity within a third-party cloud storage service, which is currently shared by both LastPass and its affiliate, GoTo," the company said. "We have determined that an unauthorized party, using information obtained in the August 2022 incident, was able to gain access to certain elements of our customers' information." Lastpass said it hired security firm Mandiant to investigate the incident and notified law enforcement of the attack. It also noted that customers' passwords have not been compromised and "remain safely encrypted due to LastPass's Zero Knowledge architecture."

An anonymous reader shares a report: Fifteen years after the release of the iPhone, it's easy to overlook the role early innovators like Palm played in popularizing the smartphone. By the time HP unceremoniously shut down the company in 2011, Palm had struggled for a few years to carve out a niche for itself among Apple and Google. But ask anyone who had a chance to use a Palm PDA in the late '90s or early 2000s and they'll tell you how fondly they remember the hardware and software that made the company's vision possible. Now, it's easier than ever to see what made Palm OS so special back in its day. Last week, archivist Jason Scott uploaded a database of Palm OS apps to the Internet Archive. In all, there are about 560 programs to check out, including old favorites like DopeWars and SpaceTrader. Even if you don't have any nostalgia for Palm, it's well worth spending a few minutes with the collection to see how much -- or, in some cases, little -- things have changed since Palm OS was a dominant player in the market. For instance, there's an entire section devoted to shareware and it's interesting to see just how much some developers thought it was appropriate to pay for their software. Japanese electronics and printer maker Epson announced this month that it will end the sale and distribution of laser printer hardware by 2026, citing sustainability issues. From a report: According to the company, inkjets have a "greater potential" than laser printers to make "meaningful advances" when it comes to the environment. The company already halted laser printer sales in many markets, but continued in Asia and Europe. Even though new hardware would be unavailable everywhere, Epson said it would continue to support consumers with consumables and spare parts. "As a company we're totally committed to sustainable innovation and action, and inkjets simply use less energy and fewer consumable parts," explained Epson sales and marketing manager Koichi Kubota in canned statement. "While laser printers work by heating and fusing toner to a page, Epson's Heat-Free inkjet technology consumes less electricity by using mechanical energy to fire ink onto the page."

Japan's core consumer inflation accelerated to a 40-year high in October as a weak yen pushed up the cost of imported commodities, which were already surging due to global supply constraints. From a report: The data suggests Japanese companies may be shaking off their deflationary mindset as they gradually raise prices of everything from fuel to food while coming under pressure from cost-push inflation. The nationwide core consumer price index (CPI), which excludes volatile fresh food prices but includes energy, rose 3.6% year on year in October, versus a 3.5% rise expected by economists, and accelerating from the prior month's 3.0% gain. The jump marked the fastest gain since February 1982. It also confirmed CPI growth remained above the Bank of Japan's (BOJ) 2% inflation goal for a seventh straight month. Despite broadening price pressures, which are a growing concern for households, however, the BOJ would not join a global trend of tightening monetary policy through rate hikes. BOJ Gov. Haruhiko Kuroda reiterated on Thursday a pledge to maintain monetary stimulus to support a fragile economy facing still weak inflation and reeling from the COVID downturn.

Japan said on Friday it will invest up to 70 billion yen ($500 million) in a new semiconductor company led by tech firms including Sony and NEC as it rushes to re-establish itself as a lead maker of advanced chips. From a report: "Semiconductors are going to be a critical component for the development of new leading-edge technologies such as AI, digital industries and in healthcare," Minister of Economy, Trade and Industry Yasutoshi Nishimura said at a news briefing. The new chip company will be named Rapidus and aims to begin making chips in the second half of the decade, he added. As trade friction between the United States and China deepens and Washington restricts Beijing's access to advanced semiconductor technology, Japan is rushing to revive its chip manufacturing base to ensure its carmakers and information technology companies do not run short of the key component. Japan is also concerned that China may attempt to take control of Taiwan, the global hub for advanced chip production.

"We have determined that an unauthorized party gained access to portions of the LastPass development environment through a single compromised developer account and took portions of source code and some proprietary LastPass technical information," reads the official message published. They also clarify that no user data was lost. "We never store or have knowledge of your Master Password," the firm said in an FAQ. "We utilize an industry standard Zero Knowledge architecture that ensures LastPass can never know or gain access to our customers' Master Password", they inform. Hence, no action is required to users to follow.

The Japanese government warned of possible power shortages Monday in the Tokyo region, asking people to conserve energy as the country endures an unusually intense heat wave. From a report: Weather officials have announced the earliest end to the annual summer rainy season since the Japan Meteorological Agency began keeping records in 1951. The rains usually temper summer heat, often well into July. The economy and industry ministry urged people living in the region serviced by the Tokyo Electric Power Co. to conserve power in the afternoon, especially when demand peaks at 4-5 p.m.

A city in Japan has been forced to apologise after a contractor admitted he had lost a USB memory stick containing the personal data of almost half a million residents after an alcohol-fuelled night out. From a report: Officials in Amagasaki, western Japan, said the man -- an unnamed employee of a private contractor hired to oversee Covid-19 relief payments to local households -- had taken the flash drive from the city's offices to transfer the data at a call centre in nearby Osaka. After spending Tuesday evening drinking at a restaurant, he realised on his way home that the bag containing the drive was missing, along with the personal details of all 460,000 Amagasaki residents. He reported the loss to police the following morning. The information included the residents' names, addresses and dates of birth, as well as details of their residence tax payments and the bank account numbers of those receiving child benefits and other welfare payments, according to the Asahi Shimbun. All of the information is encrypted and password protected, and there have been no reports of data leaks.
